[Handling of Personal Information and the User Policy of My Page]

 

▼Handling of Personal Information
Pasona HR Solution (hereinafter referred to as "Pasona HR Solution") will handle the acquired personal information as follows.

■Purposes of Personal Information Use acquired by this Form
Acquired personal information is used for the following purposes:
・Contact with applicants and operational management of seminars held by our company
・Response to inquiries
・Introduction of other seminars, services and campaigns
・Request for questionnaires
・Request for opinions and feedback after participation in seminars
・Creation of statistical information

■Provision of Personal Information to Third Parties
Depending on the seminar courses, there are cases where the acquired personal information will be provided to WSET(Wine & Sprit Education Trust) , WSG(Wine Scholar Guild), Wines of Germany, Japan-Winery-Award.

[User Policy of “My Page”]

When using “My Page” (hereinafter called the “Service”) provided by Pasona HR Solution (hereinafter called “Pasona HR Solution”), please use it after agreeing to the user policy (hereinafter called the “Policy”) as prescribed below.

Chapter 1 Use of the Service

1. User
User described in the Policy means the person who applies to the Service by the method stipulated by Pasona HR Solution and receives the Service.

2. Contents of the Service
An exclusive page for the User is provided the following functions.
- Simplifying application for learning courses
- Browsing the learning history of courses
- Compiling the registration of Personal Information

3. Registration by User
(1) The User shall provide the personal information to apply and register for the Service by the method stipulated by Pasona HR Solution.
(2) Pasona HR Solution shall provide a password to the User for use of the Service.

4. Management Responsibility by Applicant
(1) The User shall strictly control the mail address and the password recorded at the time of registration (hereinafter collectively called “Log-in Information”) and may not disclose or lend it to any third parties because it is used to identify the User in the Service.
(2) The User shall be responsible for the use, change and control of Log-in Information and agree to all actions using Log-in Information deemed to have been executed by the User. Pasona HR Solution shall not be responsible for any damages caused by insufficient management and faults by the User.
(3) Pasona HR Solution shall not be responsible for any damages caused by the use of Log-in Information by a third party regardless of intention or negligence by the User.

5. Prohibited Matters
The User may not execute the following actions when using the Service.
- Action of sending or registering false information when using or registering the Service.
- Action of using the information acquired by the Service for the purpose of trade in business
- Action of violating laws or likely violate laws
- Action of transferring the right related to use of the Service and other services provided by Pasona HR Solution
- Action against public order and morals or other inappropriate actions judged by Pasona HR Solution

6. Notice of Change
(1) In cases where any change in the information notified at the time of registration of the Service occurs, the User shall notify the change soon by the method stipulated by Pasona HR Solution,
(2) Even if the User suffers a disadvantage because the notice of change prescribed in the preceding paragraph has not been made, Pasona HR Solution shall not be responsible for any disadvantage.

Chapter 2 Provision of the Service

1. Provision of the Service
Pasona HR Solution shall provide the Service and individual services related to the Service to the User according to the judgment of Pasona HR Solution. And even after the registration of the Service, Pasona HR Solution may refuse to provide all of the services, if the fact that the User violated the Policy in the services provided by Pasona HR Solution in the past is revealed.

2. Notice and Information Provision to the User
(1) The User shall agree with Pasona HR Solution who uses the e-mail address registered at Pasona HR Solution to provide notice and information. However, the User may request to stop the provision of notice and information by the method stipulated by Pasona HR Solution except necessary notice.
(2) Even if the notice or information causes damages to the User or a third party, Pasona HR Solution shall not be responsible for the damages.
(3) In cases where Pasona HR Solution sent notice, inquiry or confirmation, or mailed documents to the contact address registered at Pasona HR Solution and late delivery or non-delivery occurred due to reasons attributable to the User, such as negligence to notify the correct contact address etc., they shall be deemed to have been arrived at the time when they should be normally arrived. And late delivery or non-delivery caused by faults of communication device, circuit and computer, or fault of communication means, such as disconnection of electric mail and telephone not attributable to Pasona HR Solution, shall also be deemed to be the same.

3. Change or Suspension of the Service
(1) Pasona HR Solution may stop or temporarily suspend the Service without notice to the User or the User’s consent in advance when the following cases of natural disaster or other unavoidable situation on business management occurs.
- When necessary for system maintenance and others such as execution of the Service,
- When difficult to continue the Service due to natural disasters, power failure or others,
- When Pasona HR Solution judges necessity
(2) Pasona HR Solution shall not be responsible for any damages caused by temporary suspension or cancellation of the Service.
(3) Pasona HR Solution may terminate to provide the Service when the business terminates.

4. Termination of the Service
(1) Pasona HR Solution shall terminate the Service when the User requests to terminate of the Service.
(2) Pasona HR Solution may terminate the Service without notice in advance when the act of the User falls under either of the following cases.
- Case that the User makes false declaration or registration when using the Service or other services provided by Pasona HR Solution
- Case that no response to Pasona HR Solution is made without reasonable reasons
- Case that Pasona HR Solution judges difficult to maintain the trust relationship with the User who repeats requirements beyond the scope of the services provided by Pasona HR Solution and disturbs management of the Service.

Chapter 3 Handling of Information in the Service

1. Handling of Personal Information Protection
Pasona HR Solution shall properly acquire, use, provide and manage the personal information of the User according to “Handling of Personal Information” and “Privacy Policy” stipulated separately, in addition to the Policy and other policies of each service provided by Pasona HR Solution.

2. Accuracy of Personal Information
(1) The User shall guarantee and be responsible for the data accurate and up to date in relation to the information provided or disclosed to Capan and a third party to whom the data is necessary to be provided.
(2) In cases where a third party files any notice of opposition, request or requirement caused by the reason that the information provided by the User was not accurate and that the data was contradicted or default, the User shall be liable for the costs and shall not charge them to Pasona HR Solution.

3. Information Processing
Pasona HR Solution may process information except the information that can identify the specific individuals among the Users’ information and shall use it for various media compiled and issued by Pasona HR Solution. In this case, copyrights and other related rights regarding the said information used for various media shall belong to Pasona HR Solution.

4. Information Use
Pasona HR Solution shall measure the use status of the Service by the User through Server and Google Analytics in order to improve the convenience of the User in the Service. Please refer to “Data Protection of Google Analytics” as for privacy and security of Google Analytics. And Pasona HR Solution shall publish advertisements by the following methods, based on the information of the User and of visit/access history by the User.
(1) Visit and access history by the User shall be acquired by Cookie and selected advertisements that likely meet the User’s interest and concern shall be published on various Internet sites of trustees including Yahoo! JAPAN and Google. Cookie does not acquire information that identifies a specific individual though the system of Cookie retains access history, input data etc., in the files of the User’s communication terminal. And Cookie can be set to limit the use scope of browser. The user can disable the functions at the web sites of “Access Targeting Advertisement distributed by Yahoo! JAPAN” and “Control of Google Advertisement” when the User does not desire the advertisements distributed by trustees including Yahoo! JAPAN and Google.
(2) Selected advertisements that likely meet the User’s interest and concern shall be published on Facebook, based on Custom Audience and visit/access history of the User acquired by the User’s information such as Cookie, Tag, communication terminal ID etc., of Facebook. Customer Audience means distribution target of advertisements made by visit/access history of the User and by converted data of personal information that cannot be restored. Please refer to “Data Policy of Facebook” as for data protection acquired by Facebook and also refer to “Facebook Advertisement” after logging in when the User does not desire the advertisements distributed by Facebook.

Chapter 4 Others

1. Eradication of Anti-social Forces
The User shall pledge not to fall under (1) described below at preset, and not to fall under (1) and (2) below in future as well. In cases where the User violates this Article and Pasona HR Solution terminates the Service, the User shall not file any objections.
(1) Anti-social forces (a member of organized crime group, a quasi-member of any organized crime group, a member affiliated with any organized crime group, corporate racketeer, a member affiliated with any special intelligence organized crime group, a person who has not been any of the foregoing during the past 5 years, or any person engaged in any act that is contrary to public interest)
(2) Any act of making a demand in a violent manner, any act of making an unreasonable demand beyond legal responsibilities, any act of using intimidation or violence in connection with a business transaction, any act of defaming the reputation of or interfering with the business by spreading rumors or using fraudulent or forceful means

2. Disclaimer Clauses
(1) Pasona HR Solution shall not guarantee completeness, accuracy, usefulness etc., of the information and the contents for use of the Service.
(2) Pasona HR Solution shall not guarantee completeness, security etc., of the Service though Pasona HR Solution judges that safety control measures of the system including cryptographic techniques adopted by Pasona HR Solution are reasonable. The User shall be deemed to have agreed to safety control measures of the system adopted by Pasona HR Solution and to characteristics of communication route such as public network, specialized telephone line, Internet etc., when using the Service.
(3) Pasona HR Solution shall not be responsible for any damages of the User caused by using the Service.
(4) Pasona HR Solution shall not be responsible even if the communication terminal of the User does not work correctly.

3. Force Majeure
In cases where the Service is delayed, difficult or disabled to provide due to a convulsion of nature, a communication failure on a network, virus damages difficult to be prevented by normal anti-virus control measures and others not attributable to Pasona HR Solution, Pasona HR Solution shall not be responsible for any damages of the User caused by this.

4. Liability for Damages
In cases where the User violates the provisions of the Policy and causes damage to other users, Pasona HR Solution, the party concerned or third parties, the User shall compensate for the damages.

5. Change of the Policy
Pasona HR Solution shall change the contents of the Services if necessary. The new contents of the Policy after change shall be published on User Policy of “My Page” linked by the web site of the Service and the User who has been successively using the Service shall be deemed to have agreed to the new contents of the Policy after one month from the publication.

6. Matters not provided for in the Policy
Matters not provided for in the Policy shall be governed by the laws of Japan and shall be resolved by consultation in good faith between the User and Pasona HR Solution.

7. Court with Jurisdiction
In cases where a dispute regarding the provisions of the Policy arises, the Tokyo Summary Court or the Tokyo District Court shall be the exclusive agreement jurisdictional court in the first instance.
